Consignor Agreement Fall 2009
In
consideration for the opportunity to participate in and profit
from the Best Dressed for Less (BDFL), the undersigned Consignor
agrees to the following:
1. Consignor agrees to hold harmless and make no claim against
Colleen Tobias and/or Kristine Sager, Best Dressed for Less
(BDFL), leaser or owner of the space where the sale is held, any
volunteer or paid participants in the BDFL, or the insurer of
the BDFL for the damage, theft, or loss of any items consigned
to BDFL. BDFL does not anticipate any thefts, damage, or loss
and takes every precaution to prevent them, but occasionally
these events may occur.
2. Consignor
agrees to waive any and all claims for personal injury resulting
from participation in the BDFL from whatever cause either
foreseen or unforeseen against Colleen Tobias, Kristine Sager,
leaser or owner of the space where the sale is held, any
volunteer or paid participants in the BDFL, or the insurer of
the BDFL.
3. Consignor
agree to pay a $10 non-refundable consignor fee (via paypal) at
time of on-line registration.
4. Consignor
will receive 60% of the sales price on items that sell. In
addition, sellers can earn another 5% by volunteering a 4-hour shift
before, during, or after the sale. Consignors who volunteer one four
hour shift earn 65% of their total sales. Consignors who
volunteer
two four hour shifts earn 70% of their total sales.

PENALTIES:
If a
Consignor signs up to volunteer and does not complete the shift BDFL will deduct 30% from their final earnings
check. If
the consignor sends a replacement, the benefits will not change.
Extenuating circumstances may be considered (such as a death in
the family) and the consignor would be allowed to volunteer
again, but the deduction may still be taken at the discretion of
Best Dressed for Less management.
If a consignor requests unsold items be sorted for pick
up but does not pick up items (or send someone
to do it) they will be charged a $20 fine. If the consignor
looses their commission check, a $30 stop payment fee will be
deducted from the replacement check.
6.
IMPORTANT: Any
consignor who earns more than $599 per tax year (from just one
sale or two sales combined) while consigning with Best Dressed
for Less MUST provide BDFL organizers their Social Security
Number or Taxpayer identification number. BDFL IS REQUIRED BY
LAW TO REPORT ALL CONSIGNOR EARNINGS OF MORE THAN $599 (PER TAX
YEAR) TO THE IRS AND ISSUE THE CONSIGNOR AN IRS FORM 1099. If a
consignor earns more than $599 in one tax year and REFUSES to
provide BDFL with their Social Security number or taxpayer
identification number BDFL will hold their earnings check until
the SS number or taxpayer identification number is provided.
7.
Consignor accepts responsibility for ensuring that consigned
items have not been recalled.
8.
Consignor agrees that during the half price sale some items may be sold for half of the price originally designated by
the Consignor if the Consignor has marked Discount-yes on the
item tag.
9.
All goods left in the possession of BDFL are at the sole risk of
the consignor. Consignor agrees that he/she shall assume and
bear all risks regarding consigned goods, and will hold BDFL
exempt from any and all liability. Should items be lost,
stolen or damaged, BDFL is not responsible to compensate the
consignor for the items.
10.
BDFL reserves the right to remove any items from the sale due to
wear, poor condition, stains, odor, or CPSC recalls. Items not
picked up by consignors after 9 pm on Sunday will become property of BDFL and will be donated to charity.
11. Consignor
agrees that no claims will be made against BDFL for any
discrepancies involving items placed in the sale.
12.
Consignor agrees that unsold items marked with Donate on the tag
will be donated at the end of the sale.
13. All merchandise without
tags that is not claimed will automatically be donated.
Each
Consignor agrees to this disclaimer form when they choose to
sell their items at BDFL. It is assumed that the Consignor
agrees to the form when they leave their items with BDFL for the
purpose of consignment.
